Terms and Conditions of Sale
1. The Artwork
- Originality & Authenticity: Each artwork is an original creation or a limited edition print by the Artist. A signed Certificate of Authenticity will be included with every purchase.
- Descriptions: Every effort is made to represent colors and textures accurately. However, please note that variations may occur due to digital screen settings.
2. Orders and Payment
- Full Payment: To secure an artwork, full payment is required at the time of purchase. Orders will only be processed and prepared for shipping once payment has cleared.
- Taxes: Prices are subject to applicable Canadian taxes (GST/PST) based on your location at checkout. International buyers are responsible for any import duties or custom fees incurred upon delivery.
3. Shipping and Insurance
- Inclusive Pricing: The listed price includes all standard shipping and insurance costs.
- Delivery Timeline: Please allow 2–3 weeks for the professional packaging and delivery of your artwork.
- Damage in Transit: Your work is fully insured during transit. If an item arrives damaged, you must notify the Artist within 48 hours of receipt with photographic evidence of the damage and packaging to facilitate an insurance claim.
4. Returns and Refunds
- 14-Day Review Period: You have 14 days from the date of receipt to decide if the artwork is right for your space.
- Return Process: If you choose to return the work, you must notify the Artist within this 14-day window. The artwork must be returned in its original condition and packaging.
- Return Costs: The buyer is responsible for all return shipping and insurance costs. A refund of the original purchase price will be issued once the Artist receives the work and confirms its original condition.
5. Intellectual Property & Moral Rights
- Copyright Retention: The purchase of the physical artwork does not transfer copyright. The Artist retains all rights to reproduction, including the right to use images of the work for promotional purposes.
- Moral Rights: In accordance with the Canadian Copyright Act, the Artist retains all moral rights to the work. The artwork may not be modified, distorted, or used in any way that prejudices the Artist’s reputation.
6. Privacy
- Data Protection: Your personal information (name, address, and contact details) is collected solely for the purpose of fulfilling your order and will not be shared with third parties, except as required for shipping and payment processing.
7. Governing Law
- Jurisdiction: These terms are governed by the laws of the Province of Saskatchewan
and the federal laws of Canada. Any disputes arising from this agreement shall be resolved within the jurisdiction of Saskatchewan.
8. Force Majeure
- Unforeseen Delays: The Artist is not liable for delays caused by circumstances beyond their reasonable control, such as postal strikes, extreme weather, or natural disasters.
